EliteHR Terms of Service
This is a legal agreement between you or the entity you represent (referred to as “You” or “Your”) and Efortek Limited (referred to as “Efortek”), governing your use of the EliteHR system (referred to as “EliteHR” or “the Software”).
1. Acceptance of Terms
By using EliteHR, you agree to be bound by these Terms of Service. You must be of legal age to enter into a binding agreement. If you do not agree to the terms, you may not use the Software. Acceptance is indicated by checking a box, clicking “I agree,” or using the Software in any way.
2. Description of Software
EliteHR is a Human Resource Management (HRM) system developed and provided by Efortek Limited. It is accessible via supported web browsers and may be used for internal HR-related activities such as employee management, payroll, leave tracking, and more. Internet access and compatible devices are required for optimal use.
3. Modification of Terms
Efortek reserves the right to update these Terms at any time. If changes affect your rights, you’ll receive at least 30 days' notice by email. If you disagree with any updates, you may terminate your use of the Software and request a prorated refund of any prepaid fees. Continued use after updates implies agreement to the new terms.
4. User Account Obligations
To use EliteHR, you must create a user account and provide accurate, current, and complete information. You agree to update this information when needed. Failure to do so may result in suspension or termination of your account.
5. Organization Accounts and Admins
Organizations using EliteHR must appoint administrators who will manage user access and configurations. If a third party sets up your account, ensure proper agreements are in place. You're responsible for maintaining admin account security and may define a recovery process by contacting admin@efortek.co.ke.
6. Self-Hosted Version
6.1 License Rights
You are granted a non-exclusive, non-transferable license to use EliteHR in accordance with these terms for the agreed license period.
6.2 Number of Instances
Unless specified otherwise, each license allows one installation instance on your own servers or trusted third-party infrastructure.
6.3 Your Modifications
If you modify the source code (where permitted), it is solely for internal purposes. Efortek does not offer support or warranty for any modified versions. You agree to indemnify Efortek against any issues arising from such modifications.
6.4 Attribution
If applicable, “Powered by Efortek” or similar attributions must remain visible unless explicitly removed with written permission.
6.5 Support
Support is only provided for bugs in official releases. Issues caused by outdated software, unsupported environments, or custom modifications are not covered.
7. Privacy & Data Protection
Your use of EliteHR is governed by the EliteHR Privacy Policy. You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at admin@efortek.co.ke of any unauthorized access.
8. Communications
You may receive administrative messages and service announcements as part of EliteHR usage. You can opt out of promotional emails, but not system-related communications.
9. Complaints
If we receive a complaint about your usage, we will notify you. You must respond to the complainant within 10 days and copy us in your response. Failure to respond may result in Efortek disclosing your contact details to the complainant.
10. Subscription, Fees & Payments
EliteHR is offered on a monthly subscription basis. Subscriptions renew automatically unless cancelled at least 7 days before renewal. Any price changes will apply only at the start of a new billing cycle. You will never be charged without consent.
11. Restrictions on Use
You may not:
Sell or sublicense the Software
Use EliteHR to offer services to third parties without permission
Misuse third-party data or resources
Upload unlawful or harmful content
Overload our infrastructure
12. Spamming & Illegal Activities
You are solely responsible for your content. Do not use EliteHR to distribute spam, malware, or illegal material. We reserve the right to terminate accounts involved in such activities.
13. Inactive Accounts
Unpaid accounts inactive for 120 consecutive days may be terminated with prior notice. Data will be deleted unless backed up before termination.
14. Data Ownership
You own all content you create or upload. We only access your data to provide the service. Efortek will never use, sell, or share your content for marketing or commercial purposes without your permission.
15. User Generated Content
You're responsible for content shared or published through EliteHR. Public content may be indexed by search engines. You agree not to upload copyrighted or infringing material without proper rights.
16. Disclaimer of Warranties
EliteHR is provided “as-is” without warranties of any kind. We do not guarantee uninterrupted or error-free service.
17. Limitation of Liability
Efortek shall not be liable for indirect or incidental damages, including data loss, business interruption, or system failures. Our total liability is limited to the amount paid by you in the 6 months preceding the claim.
18. Indemnification
You agree to indemnify and hold harmless Efortek, its affiliates, and employees from any claims, damages, or legal fees arising from your use of the Software or violation of these Terms.
19. Suspension & Termination
We may suspend or terminate your account for:
Policy violations
Legal compliance
Security threats
Extended inactivity
You may terminate your account anytime by notifying us. Refunds will be prorated where applicable.
